Gladue report programs in Ontario

Have 11 Gladue aftercare workers who assist with ensuring Gladue report recommendations are followed, provide support to the client.

Gladue report or letter requests are to come from defence counsel directly by emailing or faxing the form to the appropriate person.

The form can be found on the Aboriginal Legal website.

• Write reports for those who have plead guilty and/or found guilty
• Often write reports for offenders facing 90 days or more
• Where it is less than 90 days, ALS can write a Gladue letter.
• Often takes six to eight weeks for reports to be prepared

in order to prepare the report they require:

• A completed Request Form
• Synopsis or Agreed Statement of Facts for the offence(s)
• The client’s prior criminal record (if applicable)
• A list of the charge(s) the client has pled to
• Contact Information – if the client is out-of-custody

• Client must self-identify as a FNIM [First Nations, Inuit, Metis] person.
• Client has pled guilty or has been found guilty and Crown is seeking more than 90 days of incarceration.

Requests:

• Can be made by a judge, defence or crown counsel or the defendant themselves.
• An application form must be submitted that includes the client’s date of birth, court jurisdiction where the matter is being heard, judge/crown/defence names and client contact information.
• The request must also include the following: a list of the charges the client has pled to or been found guilty of, a synopsis or agreed upon statement of facts for the offence(s), the client’s criminal record (if any) and crown’s position.

The Thunder Bay Indian Friendship Centre will only consider preparing a Gladue report:

• after a client has pled guilty or was found guilty after trial.
• after the Crown’s initial position on sentence is known.
• for those clients where Thunder Bay is their primary residence.

Priority will be given to those clients that are facing six months or more in custody. We will also give priority for Gladue reports to Aboriginal women.

Two permanent Gladue writers

TI’s Gladue Program ensures that Inuit offenders have the opportunity to present their story to the courts of how they became involved in the criminal justice system following a guilty plea or a finding of guilt. Gladue reports and Gladue letters serve as a pre‑sentencing document for the judge to consider which highlights the offender’s background. Many of which include historical factors, social, economic and political issues such as drug and alcohol abuse, poverty, unemployment and the loss of cultural identity. Contained in the reports/letters are recommendations for access to culturally relevant and culturally appropriate alternatives to incarceration.

Gladue submissions are only done for members of the Inuit community.

Often write reports for offenders facing 90 days or more.

Gladue letters and reports are specifically for Indigenous people in Ontario who identify as women who have criminal matters before the courts in the Hamilton and Ottawa areas.

Gladue reports are completed where the Crown is seeking a custodial sentence of at least 90 days for an out-of-custody client or three additional months for a client who is in‑custody. Following a guilty plea or a finding of guilt, a letter will be prepared where the Crown is seeking 90 days or less of a custodial sentence. A brief Gladue letter identifying the Gladue factors and circumstances of the individual can also be prepared for the consideration of a bail hearing.

The Ontario Native Women’s Association (ONWA) also offers bail letters, which recommends a release plan for the accused person to the court while taking their individual circumstances and culture into meaningful consideration.
