Process for Lawyers Interested in Providing Independent Legal Representation (ILR) Services under Section 276/278 of the Criminal Code of Canada

LAO administers the submission of accounts and payments of ILR services provided under Section 276/278 of the Criminal Code of Canada. However, LAO does not administer the lists of lawyers eligible to provide ILR Services.

If you are interested in providing ILR Services under Section 276/278 of the Criminal Code of Canada, please follow the following steps depending on your situation:

I am an existing roster member:

If you are an existing roster member, please contact brena.parnes@ontario.ca at Ontario Victim Services (OVS) to seek authorization to be added to the ILR List.

Once you receive confirmation from OVS that you’ve been added to the ILR List, please advise LAO at gencasemgmt@lao.on.ca.

I am not a current roster member and am only interested in providing ILR Services under Section 276/278:

If you are not an existing roster member and are only interested in providing ILR Services, please contact brena.parnes@ontario.ca at Ontario Victim Services (OVS) to seek authorization to be added to the ILR List.

Once you receive confirmation from OVS that you’ve been added to the ILR List, please fill out the following forms available on LAO’s External Website:

  • Application for ILR Service Provision for Non Roster Members;
  • Direct Deposit Authorization Form;
  • A release for information from your professional indemnity company;
  • A release for information from the Law Society of Ontario.

Please submit these forms to rosterapps@lao.on.ca with the subject line: “Request for Authorization to Provide ILR Services Only.”

I am not a current roster member and am interested in providing ILR Services under Section 276/278 and other legal aid services:

If you are not an existing roster member and are interested in providing ILR services as well as other certificate or duty counsel services, please follow the following processes:

Please contact brena.parnes@ontario.ca at Ontario Victim Services (OVS) to seek authorization to be added to the ILR List.

Once you receive confirmation from OVS that you have been added to the ILR List, follow the process to apply to the Legal Aid Roster set out at: https://www.legalaid.on.ca/lawyers-legal-professionals/interested-in-doing-legal-aid-work/

Submit your roster application to rosterapps@lao.on.ca. In the body of your application, please indicate that you are also seeking addition to the ILR List and have received confirmation from OVS that you have been added to the ILR List. LAO will then process your roster application as with any other roster member.

Please note that membership on the roster to provide certificate and/or duty counsel services is at LAO’s sole discretion in accordance with the Roster Management Rules made under the Legal Aid Services Act, 2020.
