Guaranteed authorization process for bail review pilot

Beginning Monday, September 17, for a three‑month trial period, authorizations for bail review applications with a medium or strong chance of success will be guaranteed.
How it works
You can submit the bail review application via Legal Aid Online.
While it may take a few days, authorization is guaranteed when, in counsel’s professional opinion, the review has a “medium” or “strong” chance of success.
Counsel must indicate this in their application.
Bail reviews may also be authorized when there is a weak chance of success but counsel is of the view that there is a public interest purpose and the review would provide oversight of bail practices that negatively impact low‑income and vulnerable Ontarians.
For applications submitted outside of Legal Aid Online, clearly indicate the review’s chance of success in the letter in order to expedite processing.
Survey
At the end of the pilot, counsel will be asked to complete a survey on the number of bail review applications they submitted within the three‑month period and the results of each bail review.
