Immigration & refugee law certificate expansion
Wednesday, June 24, 2015
Lawyers will be better able to help their legal aid clients through the recently expanded coverage in refugee and immigration law. Increased tariff hours and broadened eligibility criteria are among the modifications.
Changes are effective June 8 in the areas of:
- Humanitarian and Compassionate (H&C) applications
- Stay motions – Certificates for stay motions in Federal Court have increased from 6.5 to 15 hours.
- Deferral requests
- Secondary consequences – Certificates for financially eligible accused who may not be at reasonable risk of losing their liberty but who, if convicted, may face the risk of deportation.
This expanded coverage only applies to certificates issued on or after June 8, 2015.
